The test in Bradley would come into effect if the DWP rejected findings of maladministration and that was challenged through JR.

There's also the issue of PHSO's recommendations.

The PHSO scheme was introduced at a time when JR - as we know it now - did not really exist.

There is also scope for a judicial review of the DWP - depending on its response to the PHSO's report.

The test set out in Bradley [2008] is Court of Appeal authority. However, that ruling has been criticised and is controversial: judicialpowerproject.org.uk/category/debat…

Parliament votes to approve or reject government motions.

It is VERY rare for the PHSO to directly ask Parliament to intervene and identify a mechanism for providing appropriate remedy. Can't think of a precedent here.
