What's interesting is: I'm not sure how they would handle FDCA refusals for marijuana. Marijuana is not an active ingredient in any FDA-approved drug, so it actually shouldn't fall under FDCA at all!

The tl;dr explanation of the FDCA is: if a drug has been approved as an active ingredient of a pharmaceutical in the US, it can't just be put in ingestible goods or medicinal/therapeutic goods. Hemp CBD is an active ingredient in an FDA-approved drug (Epidiolex), so this applies.
