Quite a headline from the The Associated Press given that the “escalation” here started with Texas’s refusal to provide federal officials with physical access to Shelby Park (and, through it, the border)—and the “escalation” the AP cites is … a brief that the Justice Department filed at .

I don't think it's fair to call this a 'split bench.' As Judge Rao notes in her 'statement,' which is not a dissent, 'President Trump could have intervened to protect claims of executive privilege, but did not, and so these issues are not properly before the en banc court.'
