I don’t think this is what anyone’s arguing, even if you adhere to plausibility of rights (not claims). A plausible right is necessary but not sufficient. You then need risk of irreparable harm to the right going forward. This may or may not be shown by asserting past violations.

Not unexpectedly (see below), the has indeed rejected (15-1) 's request for PMs. The decision largely reiterates 's arguments on the facts. Nicaragua was not able to show that Germany's actions are creating the risk of irreparable harm that it alleged.

I agree with the three possible outcomes that Adil Haque outlines -- my sense is that the most likely outcome is (3) and that the least likely outcome is (2). We shall see.

FWIW, my read on this. For reasons that others have raised, the ICJ would be better off taking a clear position that plausibility at the provisional measures phase encompasses rights *and* claims.
