"There is a substantial consensus among legal experts that Israel cannot continue its current Rafah offensive without violating the court’s order." I spoke w/ Amanda Taub, who also quotes Pierre d'Argent Mike Becker Adil Haque Janina Dill and others. nytimes.com/2024/05/30/wor…

It was great to speak with William Noah Glucroft and Martin Gak last week for EUobserver about #SouthAfrica v #Israel at the #ICJ and the challenges of seeking to use international courts to address the conflict in #Gaza. Thanks for having me.

The laws of war mandate protecting all civilians-the civilian hostages unlawfully held in Gaza, four of whom were rescued today, and the civilian residents of Nuseirat, dozens of whom were reportedly killed today in that rescue operation. No human life is worth more than another.

Great to be in Maastricht today to present on the ICJ and Third Party Fact-Finding at the Recharacterising International Disputes conference hosted by Maastricht Centre for Human Rights, organised by Alexandre Skander GALAND and Craig Eggett, and with great co-panelists Cecily Rose, Sarah (Sally) Thin and Nik Voulgaris.

I watched yesterday's parliamentary debate on the KlimaSeniorinnen judgment (KlimaSeniorinnen) of the European Court of Human Rights (ECHR CEDH) so you don't have to. Some thoughts (1/x). Link: youtube.com/watch?v=JVyGRS…

Mea culpa: The #ICJ advisory opinion on #Palestine is coming out much sooner than I would have expected, so my apologies to everyone who I suggested was being overly optimistic in expecting a decision before the autumn.

What will the Intl Court of Justice decide in its blockbuster opinion due this Fri on the legal consequences of Israel’s occupation of Palestinian Territory? The ICJ doesn’t always follow precedent, but the best indication of what it will decide is what it decided last time.🧵

Short thread: tomorrow the CIJ_ICJ will give its advisory opinion on the prolonged occupation of the Occupied Palestinian Territory. What’s at stake ? Many questions but maybe a central one is if and when can an “occupation” become illegal in international law.

There will be talk about ambiguities of language, but I think it's safe to say that, starting from today, the mainstream position under Public International Law will be that Israel established an apartheid regime in Palestinian territories.

Great to see this by TCD Law School LLM candidate Ton Nu Thanh Binh in Opinio Juris today. Binh discusses the upsurge in Article 63 intervention at the CIJ_ICJ, including factors the Court might take into account when exercising its discretion under the recently revised rules.

Palestine v Israel before CERD has been decided. It does not reach a finding of apartheid. However, in its findings of fact, it states that policies of segregation "may amount to a situation of apartheid if no action is taken by Israel to effectively address the issues raised."

Very useful analysis by David Keane on the report published yesterday by the ad hoc Conciliation Commission (established under #CERD) on #Palestine v #Israel (marking the end of an interstate process begun in 2018). Link to the report is here: ohchr.org/en/press-relea….
