We've advocated for years about the need to increase green card numbers and eliminate #percountry limits. But we also need to make sure existing GC numbers aren't wasted. This year, we risk losing 100k numbers due to the challenge of processing that many applications in time.

Pre H-4 biometrics, if an H-1B, H-4, and H4EAD application package was submitted together with H-1B as PP, USCIS would approve all 3 together. Now, USCIS will take PP fees for all 3 steps. The backlogged community bears the brunt, have no choice as alternative is job loss.

USCIS charges $410 for an I-765 and they reported in the fee rule that it takes 12 minutes to adjudicate the form. Yet they often take more than 8 months to adjudicate. This is gross mismanagement.

Even without the biometrics requirement, H4 processing times are still outrageously long. I just received approvals of the cases I filed last July/August. I have no idea what to expect on recent filings. Why isn't USCIS approving H4s with the corresponding H-1Bs? USCIS Director

Anirban Das USCIS is on record in the 2019 fee hike proposal saying an I-765 only takes 12 minutes to adjudicate. Yet they're taking often taking 8 to 12 months to work those cases. Trying to explain why these processing times are acceptable is going to be interesting.

Greg Siskind Got it. If they don't allow filing more than 180 days in advance then they MUST approve within 180 days. Else it's an automatic job loss. 12 mins/file but taking 12 months is unacceptable. Applicants suffering cos of delays. Good luck with the lawsuit. Thx for the explanation.
