Judge McConnell also reiterating that if NHS reports come before the Tribunal that do not specify provision, & there is an independently commissioned report that does, the Tribunal has to deal with the evidence before them. It is key for parents to obtain evidence

Hearing that word again - “accountability” that is the key thing that will stop the SEN crisis and I agree. If we have accountability for the unlawful decisions made - we would not have so many appeals and fundamentally, children/YP would obtain the support they need

CYP will just change settings 90% of the time DDA is evident. Has there ever been any scope for stakeholders/professionals to be able to make a claim on the behalf of a young person when it's so clear? My view is that the cases logged are just the tip of the iceberg

Interested in the DDA claims and believe this is far more common than people realise. However CYPF tend to understandably prefer a change of setting. Schools should be assessed on this within inspection frameworks. Nobody asks to see consulation responses etc

Education other than at school (EOTAS) is often misunderstood & misapplied. EOTAS is the answer only if inappropriate for a child to be educated in any school at all, not a particular school. Need to address why this child and schools are incompatible with each other.
