Judge McConnell also reiterating that if NHS reports come before the Tribunal that do not specify provision, & there is an independently commissioned report that does, the Tribunal has to deal with the evidence before them. It is key for parents to obtain evidence #SenLawConf
Hearing that word again - “accountability” that is the key thing that will stop the SEN crisis and I agree. If we have accountability for the unlawful decisions made - we would not have so many appeals and fundamentally, children/YP would obtain the support they need #SenLawConf

I would love to hear from parents of children with SEND who have had to spend money on independent reports. For OT, SALT, EP etc. Have you done this? How much have you spent? Do you feel that it is grossly unfair? #SEND #NotFineInSchool #SenLawConf
why is it ok for some people within the system to excuse long delays and lack of resource to meet demand? #senlawconf
CYP will just change settings 90% of the time DDA is evident. Has there ever been any scope for stakeholders/professionals to be able to make a claim on the behalf of a young person when it's so clear? My view is that the cases logged are just the tip of the iceberg #senlawconf
Interested in the DDA claims and believe this is far more common than people realise. However CYPF tend to understandably prefer a change of setting. Schools should be assessed on this within inspection frameworks. Nobody asks to see consulation responses etc #senlawconf
Absolutely heartbreaking hearing a local authority Head of Service for Special Educational Needs & Children with Disabilities talk of her own personal family battles. If she can’t ensure her child’s protected and supported what hope is there for your everyday parent? #senlawconf
Education other than at school (EOTAS) is often misunderstood & misapplied. EOTAS is the answer only if inappropriate for a child to be educated in any school at all, not a particular school. Need to address why this child and schools are incompatible with each other. #senlawconf
David Wolfe has explored when to undertake statutory assessment, what counts as special educational provision, why ‘waking day curriculum’ is unhelpful concept, whether duty to secure provision in section F is absolute, and difference between suitable and appropriate. #senlawconf
Wonderful start to #senlawconf - passionate and compassionate. Lots of people working in SEN want to make a difference but their hands are tied by lack of resources.
Our Senior Solicitor Hayley Mason-Seager is attending the #SENLawConf today - IPSEA discussing the recently published SEND Implementation plan and the confusion this may cause parents as it is misunderstood as law through the coming months. Another reminder - nothing has changed.
