A few thoughts for the Financial Remedies Journal ahead of Standish judgment tomorrow. FWIW I think Moor J got it right at first instance and the CofA will double down on Hart, but I have a terrible record of guessing appeal outcomes…

CofA in Standish - H’s cross appeal allowed - award reduced from £45m to £25m subject to needs determination: caselaw.nationalarchives.gov.uk/ewca/civ/2024/…

Standish - matrimonialisation/mingling/transmutation Paras 61-66: read in full. Wilson’s three K v L situations have been reformulated. Probably relevant for everyone.

Does the 2007 Hague Convention restrict the English’s courts powers to make financial orders after an overseas divorce under Part III MFPA 1984? Answers on a postcard…

Great to see another Part III leave judgment reported. But should more weight have been given to the purpose of Part III - to remedy inadequate provision from overseas proceedings - in deciding whether to grant leave when no attempt made to obtain orders where divorce took place?
