I’m going to compress, human rights law into a few sentences. The ontario of human rights code states that an individual with a disability cannot be discriminated in the provision of services. Education is a service.

If other students can be registered, And a child with a disability, or an apparent disability can be registered. School boards must accommodate the point of undue hardship. Practically speaking, tribunals, almost never allow scoreboards to claim financial undue hardship.

I’m So used to thinking about the Ontario Human Rights Code educational issues. Recently, however, when, trying to help some people in a situation, you have nothing to do with application, I find myself going back to the code.

What I’m really starting to understand is that after the Charter, The code is the highest law of the land. Any action by an individual, a business or even a government official the offends the code is vulnerable to reversal.

Even a government reg or act If it’s effect is to offend the code, will fall. Looking at what’s happening south of us, I think we are lucky that we have a charter and a human rights code. Sorry to be so heavy today. It’s just on my mind.
