Mteto Nyati You are engaging in the wrong debate, my good Sir. Equity Equivalent Investment Programmes (EEIPs) have long existed and while their overall effectiveness remains contested, that is not the core issue here.
Mteto Nyati The matter at hand is the attempt to replace the licensing requirement under the Electronic Communications Act, which mandates that any company building or operating electronic communications networks in South Africa must have 30% local HDI ownership, with compliance via EEIPs.
Mteto Nyati This is not a Broad-Based Black Economic Empowerment (B-BBEE) issue. The 30% ownership rule serves a broader purpose aligned with the specific objectives of the ECA, which go beyond what B-BBEE seeks to achieve.
Mteto Nyati Conflating the two is misleading perhaps deliberately so and risks undermining a critical sector transformation tool enshrined in legislation.
Mteto Nyati I will then withdraw, as the timing of your statement led me to believe that you were weighing in on the current debate surrounding the Minister’s policy directive, specifically, the proposed use of EEIPs as a substitute for the statutory licensing requirement under the ECA.
Mteto Nyati However, if your comment was merely a general reflection on EEIPs and not intended to support their use in place of the law’s provisions, then I withdraw my earlier remarks.
