Jarkesy is a huge win for democracy and the Seventh Amendment, and despite the doomsayers it is hardly the end of the administrative state. digitalcommons.law.uw.edu/wlr/vol98/iss4…

Finally finished reading Jarkesy in full, and despite all the Justices' hemming and hawing my central claim about public rights remains:

The evidence issue in the immunity case is the most ungrounded part. It is only by deeply disrespecting jury competency and the role of lay participation that the Court can make these types of claims. And it is particularly jarring coming on the heels of Jarkesy.

Very excited to be presenting my article “The Constitutional Right to Peremptory Challenges in Jury Selection” on Friday alongside such an amazing group of scholars—there’s still time to register!

Excited to see my new article "The Constitutional Right to Peremptory Challenges in Jury Selection" out today in the Vanderbilt Law Review! Any help getting it into the hands of Arizona public defenders would be much appreciated. Also happy to field questions. Thanks! tinyurl.com/3d7m5tuw

“And we will make it a constitutional right to have a fair and public trial by jury if you are accused of a crime” “There will be many trials sir?” “Of course not, we will coerce guilty pleas out of 92% of them.”

Good news: I'm truly honored that the Southwestern Law faculty has voted to grant me tenure! Although there are a few more hurdles before it’s all official, this vote means a great deal. Thank you to everyone who has helped me along the way! TL;DR:

A fan yells “SERENITY NOW” as the announcers make reference to Seinfeld right before George Costanza delivers his pitch. Yes, you read all that right.

Exciting to see the Fifth Circuit get this one right by extending Jarkesy to prohibit juryless FCC proceedings (and also nice to see them cite my article on the topic). The revitalization of the Seventh Amendment continues! ca5.uscourts.gov/opinions/pub/2…
