The "we" is a claim. It reflects an official, normative model of the judiciary rather than a descriptively accurate one. scholarship.law.marquette.edu/mulr/vol75/issโ€ฆ Justice White always said "we" when referring to cases in which he participated and "the Court" for everything else. Quite sensible.
