I'm genuinely interested to know which paragraphs of the judgment were thought to support this view. One only needs to read the SC's summary of the judgment (or, frankly, the tweets of the reputable discrimination lawyers on here) to know that this is not true.

What should really give us "cause for concern" is how little MPs and MSPs like Maggie Chapman MSP, John McDonnell, Lynne Featherstone, Nadia Whittome MP (to name but a few) understand about the Supreme Court or how statutory interpretation works.

Proudly proclaiming that you have an "unblemished professional record" is such a weird flex. The *vast* majority of barristers can say the same thing. But I guess that in his particular case it's more of an achievement.

Jolyon Maugham was a tax barrister who argued cases in the Supreme Court. He knows full well that the Court needed to "hear from trans people" in order to construe the Equality Act about as much as it needs to "hear from taxpayers" in order to construe a piece of tax legislation.

The one where one of his Majesty's counsel* accuses the Justices of the Supreme Court of abandoning their judicial oath (for corrupt motives?). *Yes, the very same counsel who (when it suited his narrative) explained that if the SC says it's the law, then it's the law.

Former Master of the High Court pretends not to know that the Supreme Court never hears any evidence which was not before the lower courts and, in any event, that evidence from interested groups is not even admissible in order to interpret a statute.

Sometimes, fact is stranger than fiction. I can't imagine I will ever be involved in a more extraordinary case than this one. I'm only surprised that Netflix hasn't bought the rights to the story yet ... theguardian.com/uk-news/2025/m…
