Judge Newman explains in the The Green Bag how to calculate the correct number #SCOTUS cases filed each Term! Next, can we come to a consensus on how many cases are decided by the Court each term?

I am looking forward to the Disability Rights Texas Board meeting this Saturday in Austin. This is always a great opportunity to hear from the community during the public comment period. Details below:

🚨🚨🚨 I don't normally listen to CA5's criminal cases, but this has been brought to my attention - a CA5 oral argument panel has asked for Bruen amici on the history of gun regulations, specifically on intoxicated or impaired individuals. #AppellateTwitter.

Justice Barrett's Biden v Nebraska concurrence says the Court's "initial skepticism" to agency action over major questions "might be overcome" in "some cases" by text or context showing congressional authorization. Can any cases be cited as examples to support this sentence?

CA5, en banc, stays a district court's order that had found a violation of the voting rights act in Galveston. There's a lot here - I will use this as a thread. 1/ drive.google.com/file/d/1GYzJPa…

About two-thirds of Texas prisons are not fully air conditioned. Dozens of inmates have died in the sweltering heat. At least five bills filed this session would require state prisons to be equipped with A/C, but none have received a hearing yet. texastribune.org/2025/03/26/tex…

Housing Texas prison inmates in sweltering facilities that lack air conditioning is “plainly unconstitutional,” U.S. District Judge Robert Pitman said Wednesday in a groundbreaking, 91-page ruling. CTD is among the advocacy groups who filed the suit against TDCJ.

🚨HUGE NEWS This is a rolling thread on what the ruling means in plain english, but KEY TAKEAWAYS: ▶️ There will be a trial ▶️ Plaintiffs will likely win an order for TDCJ to install permanent AC in all 101 unites. ▶️ Judge Pittman is watching TDCJ & the #txlege very closely. 🧵

See our press release on Judge Pitman’s ruling: TDCJ’s extreme heat conditions likely violate the Constitution. 📉 Lives lost 📝 Falsified records ⚖️ Eighth Amendment violations #LegislatorsWeNeedAnswers — It’s time for Texas lawmakers to get this job DONE

I agree. This is definitely a big deal. Our call to Texas lawmakers is that we should fully fund the cost to install air conditioning and heat in all Texas prisons now, in the 89th #txlege budget, prior to TDCJ being ordered to install heat and a/c by the courts.

The good news: House Bill 3006 is on the House Calendar. This bill would put air conditioning in TDCJ prisons. The bad news: it's bill number 298 on the list for second reading. If it's not heard by midnight (thursday night/friday morning), the legislation will die.
