If there is something that COA has been consistently right is on the bindingness of the Commission's recommendations. SCORK erred in Abekah and CRA and reduced article 59 and 259 to a cipher. SCORK rendered the commissions useless.COA has redeemed itself on that question.(1)

Ruling citing delay is delivered 5 years later. The Judiciary Kenya should push more interlocutory applications esp 5(2)(b)s to paper hearings the way SCORK does. CoA judges should be freed to hear main appeals. 90% of decisions seem to be interlocutories.

Even if I was inclined to waive rebuttal in the Supreme Court, I would always frame it, as I do in the courts of appeals, in terms of 'unless the Court has any further questions, we rest on our briefs' or something like that to see if any justices have lingering questions.
