Patna: We are representing a Dalit woman who filed a sexual violence case against a man (Yadav caste) in Apr ’24. When we sought her 164 statement, the court denied access-citing an old convention: certified copies of the same are not given out before they are exhibited in court.

We filed an application under Section 230 BNSS (replaced Section 207 CrPC) - which earlier gave this right only to the accused. But Section 230 BNSS explicitly extends the right to both the accused and the victim (if represented by a lawyer).
