Here is were U.S. law places the goalposts for asylum. The June rule moved the goalposts, all but deleting "whether or not at a designated port of arrival" whenever the border gets busy. Now that the border is less busy, they'd move the goalposts again, redefining "busy."

Speaking of nominees for Senate-appointed positions, my prediction is that regardless of who wins the election in November, ICE will continue to have no Senate-appointed leader. ICE is now midway through year 7 without a Senate-confirmed head.
