The very fact the U.K. has to get an agreement with a foreign power, the EU, to allow passage of UK trade deal produce to NI, underscores how much the Protocol bestowed and maintains sovereignty over NI to Brussels.

The EU judgment doesn’t apply in GB, but due to the Protocol- the relevant directive does apply in NI & due to section 7A overrides any other domestic law.

So those charged under encrochat can rely on it!

Jamie Bryson Jamie Bryson is right. The Rwanda Act was challenged on two bases: incompatibility with the Windsor Framework and incompatibility with Convention rights. It is only by the continued application of *EU* law in NI that the court was able to *disapply* provisions of the Rwanda Act

Yes Duncan but perhaps you need to read the judgment; the legislation was disapplied on the basis of **EU law** not the ECHR. Breaches of ECHR lead only to a declaration.

There is no facility for disapplication under the ECHR (applying via the HRA 1998), this tool only applies
