I think Gerald Chan is right. R v Bykovets has profound implications for s. 8 of the Charter in the digital age. It is a full-throated embrace of the Mosaic Theory of privacy. [Thread 1/]

R v Pelletier, 2024 SKCA 12: the Court entered acquittals with their analysis focusing on the importance of a temporal connection when assessing the admissibility of spontaneous utterances. Yet another great decision penned by Justice Barrington-Foote of the SKCA.

It's worth noting that $30 000 appears to be the new income cutoff for a *TWO PERSON HOUSEHOLD*. Two people living off $31 000 make too much money to access counsel through Legal Aid. legalaid.ab.ca/resources/fina…

Sarah And when we compare to the eligibility guidelines before they were significantly slashed in 2010, we see that these new numbers don't get us much higher than where we were then - as in actuals, before accounting for inflation.

Sarah I ran some rough numbers this morning... As an example, a Family of 4 in Calgary making HALF of what it takes to maintain a basic standard of living will just barely qualify for Legal Aid.

This is good news but the fact is if you make more than $30K/year, you won't qualify for Legal Aid.

To address the concerns of stakeholders and inequities in the justice system, Legal Aid coverage needs a comprehensive review. Use good ideas from other jurisdictions. Fix things.
