Congratulations to colleagues Heather Ferg Heather Ferg and Sarah Rankin Sarah, counsel on R. v. Bykovets, where the Supreme Court of Canada 🇨🇦 ruled today that there is a reasonable expectation of privacy in an internet (IP) address | cbc.ca/news/politics/…

R v Bykovets is one of the most important s. 8 Charter cases of the last decade. The Court is moving towards a mosaic theory of privacy, which will be huge in the AI, big data age. Nice to see my partner Nader R Hasan quoted in the judgment. decisions.scc-csc.ca/scc-csc/scc-cs…

Congrats to my partner Heather Ferg and associate Sarah who were counsel to Mr. Bykovets at the Supreme Court of Canada on this case. I am so proud of them for such an amazing accomplishment.

I think Gerald Chan is right. R v Bykovets has profound implications for s. 8 of the Charter in the digital age. It is a full-throated embrace of the Mosaic Theory of privacy. [Thread 1/]

Once again, in the police accountability process, the Alberta Crown Prosecution Service is exposed as a weak link.

What, if anything, has RCMP Alberta done about this misconduct?

R v Pelletier, 2024 SKCA 12: the Court entered acquittals with their analysis focusing on the importance of a temporal connection when assessing the admissibility of spontaneous utterances. Yet another great decision penned by Justice Barrington-Foote of the SKCA.

It's worth noting that $30 000 appears to be the new income cutoff for a *TWO PERSON HOUSEHOLD*. Two people living off $31 000 make too much money to access counsel through Legal Aid. legalaid.ab.ca/resources/fina…

Sarah And when we compare to the eligibility guidelines before they were significantly slashed in 2010, we see that these new numbers don't get us much higher than where we were then - as in actuals, before accounting for inflation.

Sarah I ran some rough numbers this morning... As an example, a Family of 4 in Calgary making HALF of what it takes to maintain a basic standard of living will just barely qualify for Legal Aid.

This is good news but the fact is if you make more than $30K/year, you won't qualify for Legal Aid.

To address the concerns of stakeholders and inequities in the justice system, Legal Aid coverage needs a comprehensive review. Use good ideas from other jurisdictions. Fix things.

R. v. Brunelle, 2024 SCC 3: Multiple Charter breaches may cumulatively warrant a stay of proceedings, even if individually they do not. In addition, abuse of process can operate to address police misconduct that is abusive, but which may not technically amount to a Charter breach
