I'm bit unsettled by allegations against Judge Phahlane & not because I think she is infallible but the circumstances around them. They seem to come from a disgruntled group that lost a case she adjudicated & centred on an affidavit deposed to by a lawyer struck off the roll -

Just because a judge had been charged for corruption doesn’t mean there’s “corruption in the judiciary”. Yes it’s bad that she’s charged but she’s innocent until proven guilty so slow down with the conclusions.

1. At passage 13 of her dismissal of a recusal application, she states that Mr Modise (complainant) relied on a founding affidavit written hearsay all over.

2. In terms of this FA, he admits to no personal knowledge of the allegations as they were 'reported to him by Mr. Maluleke that Mr. Twala, the respondents’ attorney, had told him that he was informed by Mr. Sandlana’s spokesperson that I have been bribed by Mr. Michael Sandlana

3. The fulcrum of the allegations appear on para 53-58 of Maluleke's (para 18 of the judgement), state the following; 'Maluleke reported that I have been sanitised'. and this was around Nov 2021. Maluleke got this from Mr Twala but Twala deposed to an answering affidavit denying

4. Of concern, atleast in law, is the 'double hearsay' where Mr Modise hears from Maluleke who hears from Mr X. All this without a single confirmatory affidavit from any of the referred parties.

5. Finally, I'm further unsettled that the 'bribe' occurred in Nov 21 where Judge Phahlane had not been allocated to the case & even before a letter was addressed to DJP on 18 March 2022. How would the Judge have been sanitised years before🤔

6. As a parting shot, the practitioner at the centre of this Judge attack committed perjury (lying under oath) & since struck off the role. I just hope our criminal justice system takes a 360 degree on this case as crucial as it is to integrity of the judiciary.
