Robin Brena just addressed the RCA’s approval of the BP to Hilcorp transfer as a case that did not use rational decision making. The financial basis is unknowable and the decision relied on secret record. The RCA has refused to release the documents.

The RCA’s attorney has started our oppositions oral arguments. His argument starts by stating this is “about what Valdez failed to do”. An evidentiary hearing was not held because a formal protest was filed. Basically stating 300 public comments mean nothing in the RCA process.

Hilcorp/Harvest’s attorney argues that Valdez cannot rely on its standing because they didn’t mention constitutional harm in its complaints with the RCA. But as one of the Supreme Court judges stated, the RCA cannot rule on constitutional issues.
