DFL Senate Majority Leader calls the Sen. Mitchell situation “heartbreaking and troubling,” but says the work of the session must go on. It’s unclear when she’ll participate in a Senate session again.

The motion to expedite a hearing on the GOP ethics complaint against DFL Sen. Nicole Mitchell failed on a 33-33 vote. Mitchell did not attend session or vote remotely.

Here is the ethics complaint filed by the Senate GOP this morning:

GOP Sen. Minority Leader Mark Johnson says they filed an ethics complaint and are simply asking for the ethics hearing to happen quickly which would allow due process for Sen. Mitchell. Expulsion could be one result of the ethics process…but lesser consequences also possible.

DFL Sen. Ron Latz of St. Louis Park says Mitchell shouldn’t be expelled based only on what the “state” has alleged in criminal court or on what the media has reported.

HAPPENING NOW: GOP Sen. Eric Lucero of St. Michael now calling for motion to expel DFL Sen. Nicole Mitchell. DFL Sen. Nick Frentz of North Mankato argues to oppose motion saying she deserves “due process.” He notes no senator has ever been expelled. An ethics complaint is filed.

BREAKING: The MN Senate GOP caucus has filed an ethics complaint against DFL Sen. Nicole Mitchell of Woodbury in the wake of her arrest and charging in a burglary case early Monday morning. Mitchell is not at today’s Senate floor session.

DEVELOPING: All eyes on MN Senate where lawmakers are returning from Passover break for first floor session since DFL Sen. Nicole Mitchell’s arrest on a burglary charge. All bills have been pulled from consideration today and she’s not expected to attend.
