The Court adopts an incredibly paternalistic view of the evidence submitted by sex workers, experts, and sex worker-led organizations and allies. It repeatedly diminishes the experience of PCEPA-related harm by stating sex workers suffer from 'misunderstanding and misreading'.

The decision shifts the blame from the effects of PCEPA-related criminalization, raids, and law enforcement to sex workers themselves, implying that harm that comes to sex workers is due to their ignorance. This comes out as paternalistic 'education' re: 'proper interpretation'.
