Mr Justice Johnson upheld, in part, claims by 3 affected families on common law, child's best interests and art. 3 grounds. Prolonged delays (averaging 10 weeks) for migrants requesting that the SSHD grant them access to benefits were central to the claims.

The art. 3 'systems' duty was breached, irrespective of the individual facts of the cases. The current practical operation of the system is incompatible with s.6 HRA 1998. Such generic findings are uncommon in my experience (see DMA [2020] for a similar outcome - pictured).
