My wife and I are trying teach our toddler manners, so before we give into any of his requests we always ask, “What’s the magic word?” And recently he’s started saying “Hocus Pocus” and damnit I really don’t want to correct him.

I'm working on a new article concerning Trump and politically polarized juries, and in going back to Aaron Burr's treason trial came across this amazing factoid:

As far as I can tell, this is the first time anyone has referred to "blue juries" (outside of a few stray references on far-right blogs). I suspect this term to get lots of play in the coming months. At the very least, my working paper has a new title...

Quoting and saving this here as another example of perceived extreme partisanship (and another stray reference to "blue juries")

Regardless of the verdict, the strength and courage of those twelve jurors should make all Americans proud. How amazing it is that every day people are empowered to decide our most momentous disputes! This is what democracy is all about.

Jarkesy is a huge win for democracy and the Seventh Amendment, and despite the doomsayers it is hardly the end of the administrative state. digitalcommons.law.uw.edu/wlr/vol98/iss4…

Finally finished reading Jarkesy in full, and despite all the Justices' hemming and hawing my central claim about public rights remains:

The evidence issue in the immunity case is the most ungrounded part. It is only by deeply disrespecting jury competency and the role of lay participation that the Court can make these types of claims. And it is particularly jarring coming on the heels of Jarkesy.
