5. This is not about Zuma contesting. This is about the power of the IEC, how we understand Section 47 of the Constitution and clarity around what remission of a sentence actually means.

3. The apex court must decide whether remission means the original sentence does not exist anymore. Dali Mpofu argued that once Zuma got remission, his 15 month sentence became a 3 month sentence.

2. If only the National Assembly can enforce Section 47 of the Constitution, a bunch of unqualified people can contest and be voted for but then disqualified when seats are allocated. What happens to those votes?

1. The MKP argued that it is not the IEC'S role to enforce Section 47 of the Constitution. Meaning the IEC doesn't have the power to vet candidates before they contest elections. That's not how the IEC understands the law.
