While we're waiting: This is Merchan's *actual* instruction about unanimity re: the underlying crime. The jury MUST be unanimous about whether an underlying crime — a conspiracy to violate NY State election law — occurred, but NOT about the 'unlawful means' Trump used to do it.

Unfortunately it's even more complicated; the instruction pertains to the crime that makes up the underlying crime or attempted crime. It's three levels down.

The jury's verdict must be unanimous, but how they arrive at it does not need to be.

the unanimity issue means only that the jury need not agree re which (or which combination of) 1, 2, and 3 were intended to be committed
