While we're waiting: This is Merchan's *actual* instruction about unanimity re: the underlying crime. The jury MUST be unanimous about whether an underlying crime — a conspiracy to violate NY State election law — occurred, but NOT about the 'unlawful means' Trump used to do it.

Unfortunately it's even more complicated; the instruction pertains to the crime that makes up the underlying crime or attempted crime. It's three levels down.

THE COURT: Do you agree, that's not ordinarily required?
TRUMP'S LAWYER EMIL BOVE: Certainly.

The jury's verdict must be unanimous, but how they arrive at it does not need to be.
