Hobson jumps back in to say once again that public policy controls. The poultry industry is heavily regulated. With that, they submit on their argument.

The judge then compliments both sides on their arguments and briefings, stating there are a limited number of relevant cases and both sides have summarized them well.

Carraway then gets to reply. He references the prosecution's argument that just because someone doesn't like law enforcement's reponse, does not mean they get to use the necessity defense. He states that, once again, this 'credibility issue' is an issue for the jury to decide

Carraway replies to the legislature argument saying that CA has not weighed in. In some jurisdictions, like CO, it's very broad. And SCOTUS has a ruling about necessity for valuable property.

There are a few more arguments around public policy and the court's role vs. the jury's role in evaluating the evidence, & a quick side discussion confirming everyone is on the same page for count 1&2 being specific intent crimes and count 3&4 being general intent crimes.

Prosecution gets a final reply. Hobson says the court doesn't need to have mistake of law play out for the jury. It's in the court's purview to deny it & there is no case law that mistake of law in belief of necessity is allowed. This would transform justifications into excuses.

Carraway replies and says that it is abundantly clear that this level of evidence is not required at this stage and he can cite case law ad nauseam to show that testimony is not required.

Carraway asks a quick question about a media request that was previously denied. The judge indicates that that request was for May, and that if there is another request he will reach out to both sides for input.

With that, the hearing is over almost 2 hours earlier than expected. Court supporters gathered outside to debrief and eat cake (from Timeless Coffee) to celebrate Zoe Rosenberg's birthday! Now we wait 2-3 weeks to hear the judge's ruling! 🤞🤞🤞

The judge has denied the motion to use the necessity defense at trial, arguing that it does not apply to nonhuman animals. This is what that means for the Perdue rescue case moving forward. #PerdueTrial #RightToRescue @aaldp_du
