I’ve always been against these War on Terror surveillance programs. I was against the Patriot Act, the FISA Amendments Act, against StellarWind, etc. When do you think I was for any of this?

FISA has its own legal universe separate from, say, the 1968 Wiretap Act. It doesn’t need to make a showing that a commission of crime is likely. Nearly all queries are rubber-stamped by the FISA court, and recipients gagged. What few guardrails exist are easily abused.

I apologize to Racket readers and “America This Week” listeners for burying the lede on FISA. The fact that the law was unilaterally re-authorized two years in a row by the DOJ in conjunction with the FISA court is the biggest scandal of all. Walter Kirn
