Just received the cover for my latest book! Coming in February 2026 to a bookstore near you in Southern Africa (available in North America and Europe, too), but published in RSA. Exciting stuff!

Going straight against Chapters 6, 7 and 12 of the Constitution. This is definitely going to end up in the Constitutional Court.

Pure populism and political sentiment... I've never heard of this appaling requirement as a consideration in any criminal system

Today is the last day that the Supreme Court sits as an 11-Justice court. In September, Mexico will have a 9-justice SC filled with government loyalists. x.com/i/broadcasts/1…

Why is bail treated not as a constitutional right but as a form of an unjustified gift by the court?🚮 Why do we have crime in the first place? Do the courts have sufficient judges to expedite criminal trials? I foresee so many constitutional challenges against this Bill(Act).

Mokitimi Tsebo Ts'osane So the fact that I'm accused of a murder automatically means the deceased's next of kin are my victims? What happened to the presumption of innocence...? what happens when I'm acquitted... such a stupid law🤦🏿‍♂️.. well like many these people pass

The Duke of KTA Mokitimi Tsebo Ts'osane Playing to the gallery, they see absolutely nothing wrong with the legal premise of this law. Ba lula ba iphaphatha mahetleng ka wave after wave of nonsensical laws. The day we see the wisdom of not electing buffoons will be the day after our country is no more.

In this paper, forthcoming in The Oxford Handbook of Law and Authoritarianism, edited by Cora Chan, Madhav Khosla, Benjamin Liebman, and Mark Tushnet, I shed light on the nature and structure of authoritarianism in Africa. All comments welcome! papers.ssrn.com/sol3/papers.cf…

Wow, the Supreme Court is so efficient when it doesn’t involve someone’s home getting bulldozed or someone being in jail for five years without a trial.

📜 A brilliant essay by MILTON CESAR JIMENEZ on the line separating constitutional amendment from constitutional dismemberment -- and whether a founding constitution can ever remain "immaculate" in the context of modern constitutional politics. Full text of the paper here, with thanks

'The bail terms must always be reasonable. The only concern is to ensure that the accused persons attend trial and nothing more. Appellate mechanisms exist to review the bail terms to ensure that they are reasonable....We do not need to be told how to do our jobs' CJ Koome

When you are free, please look for Erick Githua Kiarie and several other decisions. The social economic rights under Art 53 are not subject to progressive realisation. The state obligations are immediate. May you have a good day, ndugu.
