Recent articles in Mother Jones Jones and The Guardian cover a spurious allegation that Hindu American Foundation acts as an unregistered foreign agent of India. This claim is legally unfounded, factually incorrect, and dangerous for civil society. A short thread with facts and context 🧵

The allegation against HAF was filed by Lex Politica, a right-wing law firm retained by a pro-Khalistan gurudwara in California Khalistan is a secessionist movement calling for a theocratic Sikh state carved out of India, linked to the worst Canadian terrorist attack in history.

🔍 The accusation: That HAF coordinates with the Indian govt and promotes its policies without registering under the Foreign Agents Registration Act (FARA). 📌 But here’s what the articles leave out 👇

✅ Fact 1: HAF is a 501(c)(3) nonprofit based in Washington, D.C., run by U.S. citizens, funded by U.S. donors, and accountable to U.S. law. We have platinum transparency rating as a nonprofit. We receive no money, instructions, or legal direction from the Indian government.

✅ Fact 2: Participation in diaspora events—even ones involving foreign leaders—is completely legal and common. Many orgs do this. Let’s look at examples:

So why single out HAF? The core of the Mother Jones The Guardian pieces rely on: •A false complaint filed by a pro-Khalistan gurdwara •A misreading of Indian legal terms like “fiduciary,” •And ideologically driven sources that cite each other in a closed loop.

🎯 If DOJ applied the same logic used in the complaint, many respected diaspora orgs would be forced to register as foreign agents just for hosting cultural events. That’s not law enforcement—it’s selective enforcement.
