“Where does it end?” The exact same place as coaches’ salaries and facilities spending ends. This is the problem…it has to “end” for the athlete. It’s just market based economics for everyone else. tuscaloosanews.com/story/sports/c…

If the House settlement is approved & schools are capped on how much they can pay athletes, 3rd party NIL $ will be a recruiting differentiator. But there’s confusion on how 3rd party NIL deals will be viewed under the model envisioned by the settlement. So let’s take a look.

A look at what the rev-share MOU Big Ten schools are using with athletes looks like. While the agreement uses language to try & avoid creating an employment relationship, its terms coupled with the amount of control schools exercise over athletes likely makes that unavoidable.

This is a good example of how schools can get NIL dollars to athletes over and above the House settlement’s cap on payments from schools.

Saw an athlete contract this morning that gave the brand the right to use the athlete's NIL in their marketing in "perpetuity" (read: forever). The deal was for $500. Athletes: do not allow someone to use your NIL forever, especially not for $500.

NEW: West Virginia coach Rich Rodriguez banned players from engaging in viral TikTok dances--a move that could have unintended legal consequences. It could be used as evidence to suggest athletes should be classified as employees, attorneys tell Front Office Sports. frontofficesports.com/wvu-tiktok-dan…

Nebraska has a bill to amend its NIL law that’s gone under the radar. It gives athletes the right to enter into deals with collectives & says the NCAA can’t prohibit/interfere with that right. It also says the NCAA can’t require athletes or schools to disclose 3rd party deals.

Good look at how NIL is now used in recruiting. Schools and agents/athletes discuss a number, which is often a combination of rev-share money & third party money. The game now is figuring out how to get as much third party above the cap money to athletes as possible.
