NEW: The Ivy League’s motion to dismiss was granted at today’s hearing. Pending a filing from the judge, Penn, Harvard, and the NCAA will either be called for further arguments, or the case will be stayed as the court awaits a decision in Gaines v. NCAA.

The hearing in Massachusetts on Monday was the first in the case since Penn announced its agreement with the Department of Education to resolve an investigation into the same matter.
