On 13 December, #EU institutions will meet for the last negotiation of 2023 on the EU Directive on #ViolenceAgainstWomen & #DomesticViolence. Now is their chance to get things right & say YES to Art 5 criminalising rape, because #OnlyYesMeansYes & YES to Art 6a to #StopIGM 🧵

The EU has an opportunity to criminalize rape across the bloc, where there is an absence of consent. At the 13 December trilogue on the #ViolenceAgainstWomenDirective, we count on #France, #Germany, #Netherlands & others to say YES to article 5, because #OnlyYesMeansYes

Shamefully, 🇫🇷, 🇩🇪 & others refused to recognise that #OnlyYesMeansYes. The #IstanbulConvention requires criminalisation of rape based on absence of consent. In the #VAWDirective, the EU missed an opportunity to finally align with those standards. #LetsTalkAboutYes

While we welcome the recognition of intersectional discrimination in the Directive, we regret the omission of groups at heightened risk of #GenderBasedViolence, including LBTQI women, undocumented women and sex workers.

On 6.02 the European Parliament and EU Member States finally reached a political agreement on the Directive on combating VAD & DV. We worked on behalf of the EU intersex community to advocate for a comprehensive text that includes intersex victims of gender-based violence and DV

Notably, it is also the first time in history that intersex people are explicitly recognised as victims at a heightened risk of violence due to intersectional discrimination. This is a standard setting moment within the framework of binding EU legislation.

Due to lack of political will, notably France & Germany, it appears that the text fails to include a consent-based definition of rape falls short of explicitly ensuring protection & support for victims at a heightened risk of violence such as LGBTI victims and undocumented women
