Post Roe, it may be time to take up the question of bodily sovereignty directly. Rather than arguing about various privacy rights, the fundamental issue is the right to be free from having one’s body interfered with—even to save the life of another.

Our Constitution assumes bodily sovereignty. Protecting others, while laudable, cannot be a requirement of the State. In my mind, the Supreme Court may maintain its power, but has lost its legitimacy in failing to protect this most fundamental requirement of freedom.

Watching the news tonight it makes me wonder: how many people would have to be killed in mass shootings for Republicans to act? I fear the answer is there is no number, no point at which Republicans would limit the NRA’s profiteering (which lines their own campaign coffers).

That sort of ideology is a sickness-one that in medical contexts might be evidence of incapacity—the inability to weigh the risks, benefits, and alternatives to a course of action. It’s time for ethicists to translate the reasoning we use in medicine to other moral tragedies.
