Contained within this year's Mil Con-VA appropriations bill (H.R. 3944) which is inching closer to President Trump's desk is Section 412 which would repeal the veterans gun ban by stopping new names going into NICS without due process. But it's not enough! ...

The Trump administration has the power TODAY to remove the current NICS list of 200,000+ veterans who should never have lost their 2A rights in the first place.

During debate of H.R. 3944 last Friday, Senator Senator John Boozman (R-AR) highlighted a very key phrase in the proposed text that would change the standard of adjudication back to the Judicial Branch. "by a judge, magistrate, or other judicial authority".

This fixes the problem at the VA going forward, but sadly this does not fix the larger problem with the ATF/DOJ/FBI wrongfully accepting names elsewhere. This won't be fixed until the Clinton-era ATF rule making found in in 27 CFR § 478.11(a) is rescinded! 🔥

Allowing non judicial entities like government bureaucrats at the VA to "adjudicate" someone's Constitutional rights away is a violation of separation of powers.

The phrase “board, commission or other lawful authority” violates everything the Bill of Rights stands for. It was never codified by Congress. Not even in the 2007 NIAA, which referenced the CFR, but did not add it to United States Code.

You name the three letter agency, and 27 CFR § 478.11(a) as currently written is a gateway for them to find a reason -- any reason -- to declare millions "mentally defective" and take gun rights en mass without a court, judge or due process.

And don't even get me started with how bad STATE level agencies are when it comes to reporting names to the FBI as "adjudicated" mental defective for purposes of stripping gun rights under the GCA. (Pennsylvania just might be worse than California!)

Frankly, that is why National Association for Gun Rights supports a complete REPEAL the Brady-NICS system and dismantling the wildly inaccurate and redundant NICS Indices (no guns list) entirely. Until then....
