While I’ve had increasingly mixed feelings over whether acknowledgements to Indigenous peoples simply assuage guilt while justifying inaction, this one goes further than the Supreme Court of Canada in R v Marshall where I was counsel. This one is educational, not tokenism.

Government of Canada calls these “Fantasy Passports.” I’ve heard term many times as I served as an Executive there. Only since entering private practice working for Indigenous peoples did I question validity of that condemnation. If UNDRIP promises are real, why not passports?

Regrettably when I was McGill Faculty of Law | Faculté de droit there was a single Aboriginal law course, which I neglected to take. Fortunately others have since taught me a few things as I now run right test cases up to level of Supreme Court of Canada . But this full text online journal shows how far school has come!

While this may be a UK case its principles are equally applicable in Canada. In my broad Public Law practice, it’s immigration decisions by government that consistently make the least sense. I often ask myself: Why? Only through policy development can we secure fairer outcomes
