Just so we're clear here, this comes in the context of a bill passed by Congress and signed by a president to remove funding from an organization funded by a bill passed by Congress and signed by the president. There is no legal justification. A lower judiciary run rampant.

Apparently, the Constitution means that if Congress won’t fund Planned Parenthood, a judge in the District of Massachusetts will. And it’s a Bill of Attainder if Congress ever decides not to fund any group that has previously been funded. It’s a one-way ratchet. Who knew?

This is an almost sanctionably frivolous argument. Stopping funding to Planned Parenthood cannot be a bill of attainder not least because PP does not (and cannot) have a vested property right in as-yet-unappropriated payments. And plenty more reasons besides.

I support judicial review, but if it is to survive another 250 years, the judges need to show their work. I've seen a whole lot of court orders in recent years that had more holes in them than Swiss cheese, but they were markedly better than the new genre of ex parte TROs.
