A major win against tariff overreach: the trade court just struck down Trump’s IEEPA-based tariffs, ruling them illegal and ordering them ended immediately. Not all of his tariffs, but now the real question is whether he obeys the ruling.

US Court of International Trade just issued decision in case against Trump tariffs filed by Liberty Justice Center and me. All "Liberation Day"/IEEPA tariffs ruled illegal, and blocked by injunction! see link for opinion. I will have much more to say soon: cit.uscourts.gov/sites/cit/file…

So if you are a foreign government negotiating with the Trump administration about the IEEPA "Liberation Day" tariffs, and the tariffs have now been struck down (pending a probable appeal), it may be time to recalibrate your negotiating position.

Cliff notes on Section 122: the broadest reading of the statute (which has never been used or tested in court) would let Trump do across the board tariffs up to 15%, for not longer than 150 days, after which it would trigger votes in Congress. Don’t think they’ll want that

Tariffs are taxes, and the power to tax belongs to Congress. Our Founders were clear: tax policy should never rest in the hands of one person. Tariffs not only drive up costs for American families but also trample on the Constitution. It’s time Congress reasserts its authority

In simpler times in the trade policy world, we used to have fun debates over ISDS. If, like me, you miss those days, here's a new IELP blog post on ISDS.
