It's nuts. And, NetChoice notwithstanding, the First Amendment argument that governments cannot ban this kind of policy seems silly in the same way that Lochner was silly.

The Bob Jones decision may have been completely correct, but its reasoning was lazy. At the time, maybe it didn't seem that it mattered very much; decades later, figuring out the contours of that rule is rather difficult.

Post-Smith, maybe no one has that? But presumably they have a colorable "expressive association" argument.

I don't understand the Supreme Court. They had an opportunity to resolve this issue with a far less controversial case as recently as January. Instead, they punted then and decided to tackle it in a case about birthright citizenship?
