Decentralization is a good proxy for the commodity-ness of a crypto asset. Commodities are open-source, permissionless, useful and neutral by nature. Commodities trade based on supply and demand rather than expectations for the cash flows of a firm with asymmetric information.

It’s likely some permutation of the ICO will return next year. SEC responded to 2017 vintage ICOs with regulation by enforcement. Next SEC should instead create compliant paths for crypto offerings by codifying new exemptions, safe harbors and registration forms via rulemaking.

Treasury and IRS finalized new tax regulations at the eleventh hour that will make it challenging for defi protocols to function as designed and undermine the next admin’s pro-crypto policy agenda. Congress should reverse the regulations by joint resolution pursuant to the CRA.
