Agreed! My father was a chief archivist at the BC Archives and not long after my call to the bar when I was doing estate/trust related work he took me back into the stacks and showed me Sir James Douglas’ will and Grant of Probate (with a huge red seal). Makes one “cognizant”

Okay - I am STEAMING at the unstated premise of this article and at the Minister’s comments. Must we keep hammering home that charities are not “bake sale” operations - many are incredibly complex international organizations 1/2 theglobeandmail.com/canada/article…

2/2 and employees of charities and NPOs are not required to be altruistic volunteers. They are employees with all the “normal” financial stresses of life and deserve to be paid fairly for the complexity of their job. It’s 2024 - do better Pascale St-Onge

An interesting option that could be used by BC businesses (and you don’t need new legislation to do it) hakaimagazine.com/news/working-w… via Hakai Magazine

1/ it is important to understand that the categories of charities in the Income Tax Act are really not that relevant to real life and this “trend” likely isn’t meaningful Private Foundations Expand as Public Foundations Close Down in Past 10 Years carleton.ca/panl/2024/priv…

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

2/ no question there was a post Covid “shakeout” where many finally saw the light of unsustainability and folded up. The real distinction btwn charities is those who operate programs and those that grant but all types can do both

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

3/ the most restrictive category is private foundation - there are many reasons why registration as a private foundation is undesirable. If there is an uptick my thought experience is that the applicants don’t fundamentally understand what they are asking for

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

4/ when in practice I was generally structuring to avoid the private foundation designation as it hampers flexibility. There are lots of ways to have control without a private foundation designation and they aren’t that complicated

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

From my perspective very little because there is generally speaking little to distinguish between them in a practical level

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

1/Generally I think the distinction on a practical day-to-day level is pretty meaningless. Opting into a more restrictive regime is most likely a lack of understanding of the practical impact. It may also be the “ooo I have my own private foundation” effect

Margaret Mason KC (@mhmasonqc) 's Twitter Profile Photo

2/ in practice I spoke with many a potential client who wanted the perceived “status” of a private foundation w/o having a clue regarding the restrictions
