Sen Ted Cruz has reintroduced the “Keep 9” Amendment, S.J. Res 16, in the 119th Congress with 19 Senate co-sponsors: Sens, Grassley, Cornyn, Lee, Capito, Tillis, Budd, Britt, Wicker, Hyde-Smith, Cassidy, Blackburn, Hagerty, Young, Banks, Cramer, Fischer, Sheehy, Crapo and Risch.

Would last night’s Super Bowl have been worth watching if the defending champions had been able to expand the referee pool to give their allies control? Independent referees are as essential to a fair game as an independent Supreme Court is to democracy.

Hakeem Jeffries reportedly told Silicon Valley donors that Democrats plan to retake the House by “reaching toward the center.” Will “reaching out to the center” include giving up on plans to pack the Supreme Court? Will any Democrats cosponsor the Keep 9 Amendment in Congress?

The Texas State Senate, by an overwhelming bipartisan 27-3 margin just passed a Resolution urging Congress to propose the “Keep 9” Amendment to ban Supreme Court packing. 8 of 11 Texas Senate Democrats voted YES! Democrats in Congress should take notice.

As Democrats debate their future, what issue still unites them in Congress? THEY WANT TO KEEP THE POWER TO PACK THE COURT. Not a singe Democrat in this Congress has yet backed the “Keep 9”Amendment to ban Court packing even tho it was first introduced in 2020 by a Democrat!

Except for 2/3 of Congress, only 5 people, a majority of the Supreme Court, can actually limit a Presidents power. Politicians should never be able to alter the Court’s size to create a rubber-stamp majority for an authoritarian ruling party.

Supreme Court Justice Sonia Sotomayor has just called for “fearlessly independent judges.” Will she now join the late Justice Ruth Bader Ginsburg by stating her opposition to proposals to “pack the Court?” that would undermine the independence of the Supreme Court?

Even more important than what’s been done in 10O days, President Trump and Congressional leaders in both parties should think about enacting the “Keep 9”Amendment to preserve an independent Supreme Court for the next 100 years! That would be a real legacy!

Justice Ketanji Brown Jackson just attacked threats to the Supreme Court. If she thought Trump or a successor might try to expand the size of the Court to make it less independent, would she support the Keep 9 Amendment to ban Court packing?

Happy Father’s Day! Our Founding Fathers wrote our Constitution with an independent Supreme Court to protect every one of our Constitutional rights. We need to ensure the Supreme Court remains independent by enacting the Keep 9 Amendment to ban Court packing.
