No. A similar thing happened when Gordon J was part of a 2014 Federal Court decision on bank fees, and was promoted to the High Court before the appeal. She did not sit in that 2016 hearing (which overturned her judgment).

I’ve never seen a charge of “incitement to commit conspiracy” before. It seems to have been abolished as a common law offence in the UK in 1977. Did it survive the codification of inchoate offences in Vic? An AustLII search returns zero Vic cases theage.com.au/national/victo…
