Immigration attorney is speaking on immigrant employment issues & The ICE I-9 inspection targeted enforcement that took place last week in NM.

I-9s must be on file 1yr after termination or 3yrs after hire. Whichever is greater.

Businesses are granted 72hrs to answer to ICE or USMS for compliance with I-9 inspection request.

If violations are caught during inspection, they are allowed to be corrected during that inspection without penalty.

After notice of violations, you are given 10 Days to comply and fix violations.

It’s a good idea for employees to NOT answering questions from ICE inspectors. They do not have to answer any questions concerning their legal status.

In order to keep ICE inspectors out of employee working or break areas, clearly mark these areas as “Employees Only.”
