Great analysis by Aleksandra Ancite-Jepifánova. I would add one point: while one might theoretically imagine ‘no violation’ of Art. 4 Prot. 4 due to an expansive reading of the ND & NT exception, there must be a violation of Art. 3 if the Court takes its absolute character seriously.
