The Gov is rejecting a new discovery bill which would make clear that judges are not required to dismiss a case due to a discovery mistake if prosecutors exhibited “due diligence and good faith.” Prosecutors are saying that diligence is too high of a standard to hold them to.

The "crime fighting measure" is granting prosecutors more leeway to withhold evidence from the defense. Mind you this has nothing to do with the budget and doesn't belong there. Governor Hochul is derailing the state budget so she campaign on this issue next year.
