Re Sturgeon not being charged. This could be "justified" by Murrell's embezzlement charge not being directly connected to donations and the COPFS believing that no law was broken by not ringfencing donations.

Causing disrepute is a disciplinary matter and not necessarily criminal. Guilt would be judged on balance of probabilities. It was always Sturgeon's tactic to avoid internal investigations and be "cleared" through failure to find criminal intent proved beyond reasonable doubt.

As the Lord advocate has recused herself from a public prosecution of sturgeon she cannot then involve herself in a private one for the exact same offense
