2. Doesn’t the federal constitution explicitly give that power to state legislatures?  When there’s a conflict between branches in this regard, isn’t the legislature the ultimate authority under the federal constitution? This is not a “theory” this is a fact, is it not?

I just finished "Holly" by Stephen King. I absolutely loved it, and I whipped through it. It was very reminiscent of Elizabeth Bathory. The only problem is I now have to wait a whole year for the next book by Stephen King!!!
