If an offensive lineman is promised $750k in a school revenue-sharing contract as a reasonable payment for his #NIL and not pay-for-play (HAHA!), then he and similar athletes should be able to receive roughly that amount from #NIL collectives, right? It's "fair market value," no?

As I said to Amanda, determining ‘fair market value’ for #NIL deals is subjective and could lead to disputes between athletes, businesses, and this new clearinghouse operated by Deloitte. Required contract submission could also violate confidentiality clauses.

The only benefit athletes will receive from House v. NCAA is back pay, which will be in limbo once the settlement is appealed. In the future, athletes not only realize zero "phenomenal benefits," they will experience extraordinary detriments: x.com/DarrenHeitner/…

This feels like 5 years ago. States standing in the way of the NCAA and conferences seeking to restrain trade. College sports “leaders” often think they’re the smartest in the room. History says otherwise.

As I told Amanda Christovich, I've spoken with a handful of college coaches about the memo distributed by conferences that would prevent schools from suing to challenge new #NIL rules. The general consensus is that it’s a shitshow—and going to keep me busy.

Great reporting by Amanda Christovich, and some of these Charlie Baker quotes deserve more exposure. "I don't believe anything anybody tells me about what's going on in the NIL space because there's no way to verify it." - This wrongly suggests that, because perfect verification

This will never be normal. Never acceptable. We must stand together and continue to vocally denounce these acts of terrorism.

Well kept secret. I've known Andrew Brandt for a very long time and he's 1 of the best in the biz. Have already negotiated numerous contracts with him in his new-ish role. Louisville is lucky to have him in a great athletic dept led by Josh Heird.

Tennessee's athletic director, with the camera on, says that the only solution in college sports is collective bargaining. If the problem worth solving is continued antitrust litigation, then he's 100% correct.

There is a commission. There isn't a commission. Nick Saban is chairing it. Nick Saban says it isn't needed. This reminds me of what I tell my University of Miami School of Law - #MiamiLaw #NIL class on Day 1 every year: If you finish this course more confused than when you entered, you're on the right path.
